THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.14830 OF 2016 ORDER:
This criminal petition, under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.'), is filed to quash the proceedings in Crime No.175 of 2016 of Huzurnagar Police Station, Nalgonda District, registered for the offence punishable under Section 366-A IPC and Section 11(i)(iv) read with Section 12 of POCSO Act, 2012.
The main allegation made in the complaint is that the petitioner/A.6 accompanied the victim girl and A.1 on the motor cycle and she provided shelter during night.
It is the contention of the petitioner that she has no intention to commit any offence. But it appears from the material on record that the petitioner also one of the person, who cooperated with A.1, and harbored A.1 and the victim girl, which is an offence. However, when the allegations made in the complaint constitute an offence, prima facie, that is sufficient to dismiss the petition and this Court cannot go into the truth or otherwise in the allegations made in the petition, while deciding the petition under Section 482 Cr.P.C.
Therefore, I find no ground to quash the proceedings against the petitioner, however, she being a lady facing difficulty in attending courts, in those circumstances, the petitioner is permitted to move an appropriate application before the court concerned for bail, after giving notice to the public prosecutor
Crl.P._14830_2016 MSM, J - 2 - concerned, and on filing such application, the learned Magistrate requested to decide the application on the same day. With the above observation, the criminal petition is disposed of.
Miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
