Heard learned counsel for the petitioner and Sri K.Sampath Prabhakar Reddy, learned Standing Counsel for the respondents. Learned counsel for the petitioner submits that the petitioner made an application for building permission on 12.07.2017. Subsequently, the respondents issued notice dated 17.08.2017 asking the petitioner to obtain 'No Objection Certificate' from the District Collector. He submits that in view of the judgment of this Court in Hyderabad Potteries v. State of A.P1, the respondents cannot insist 'NOC'

for granting of building permission. He also relied on the order of this Court in W.P.No.42798 of 2017, dated 20.12.2017 stating that in respect of similar survey numbers, the writ petition is allowed. The submission of the learned counsel for the petitioner is not disputed by the learned Standing Counsel for the respondents. In view of the same and for the reasons alike in WP No.42798 of 2017 dated 20.12.2017, this Writ Petition is disposed of directing the respondents to consider & dispose of the application of the petitioner dated 12.07.2017 for building permission, without insisting NOC from the District Collector.

There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. 12001 (3) ALD 600
