JUDGMENT

When the matter is taken up for hearing, there is no representation for the appellant. The record is not available with the Court.

On 20.09.2022, there is no representation for the appellant and therefore, the matter was directed to be listed on 21.09.2022 under the caption "for dismissal". On 21.09.2022 Registry is directed to trace out the record, if unable to trace out, reconstruct the record. On 21.10.2022 office made an endorsement that the record is not traced out. Today also, there is no representation for the appellant. Therefore, this Court is of the considered view that no purpose would be served in continuing the appeal.

Hence, the Appeal is dismissed for non prosecution.

Pending miscellaneous applications, if any, shall stand closed.
