HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.34592 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the respondent in not considering the representations of the petitioner dated 19.12.2012, 21.08.2013, 28.08.2013, 05.10.2016 and 10.10.2016 as being illegal and arbitrary.

Heard Sri Kowturu Pavan Kumar, learned counsel for the petitioner and Sri Palle Sriharinath, learned standing counsel for T.S.D.D.Co.Operative Federation Ltd., Khammam, representing the respondent.

A perusal of the record reveals that the petitioner has been working as a distributor of the respondent corporation since 16.09.2011. The respondent corporation extended the lease agreement from time to time. Even as per the case of the petitioner, the lease period will be expired on 15.10.2016. The respondent corporation issued a tender notification on 03.10.2016 inviting applications for appointment of distributors. 4.

Learned counsel for the petitioner submitted that the petitioner submitted his application in pursuance of the tender notification dated 03.10.2016. The petitioner also submitted representations to the respondent corporation on 05.10.2016 and 10.10.2016 with a request to pay the outstanding amount to it. For one reason or other, the respondent has not considered the representations of the petitioner.

At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the respondent to consider the representations of the petitioner dated 05.10.2016 and 10.10.2016 and pass appropriate orders. Learned Standing Counsel also consented for the same.

In view of the submissions made by both the counsel, this Court is not inclined to go into the merits of the main case. 7.

Having regard to the facts and circumstances of the case and also the submissions made by both the counsel, the respondent is hereby directed to consider the representations of the petitioner dated 05.10.2016 and 10.10.2016 and pass orders in accordance with law as expeditiously as possible, preferably, within a period of four weeks from the date of receipt of copy of this order. 8.

With the above direction, the writ petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
