THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR Criminal Petition No.3897 of 2016 ORDER :

The petitioner, who is an accused, preferred the present application under Section 438 Cr.P.C., seeking release in the event of his arrest in Crime No.178 of 2015 of Railway Kodur Police Station, Kadapa District, registered for the offence punishable under Section 498(A) and 306 I.P.C. A perusal of the material on record shows that the petitioner has earlier filed Criminal Petition No.932 of 2016 before this Court seeking anticipatory bail to him. This Court by order dated 08-02-2016 dismissed the said application on merits.

In the absence of any change in the circumstances both on facts and law; as the investigation is still pending and in view of the judgment of the Apex Court in Kalyan Chandra Sarkar v. Rajesh Ranjan @ Pappu[1], the question of considering the request of the petitioner would not arise. Hence, the request of the petitioner is rejected.
