THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.3565 OF 2018 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short 'CrPC') by the sole accused to grant pre-arrest bail in Crime No.12 of 2008 of Kadiri Town Police Station, Anantapuramu District, apprehending his arrest in connection with the above crime, registered for the offence punishable under Section 306 of the Indian Penal Code, 1860 (for short 'IPC').

It is the case of the petitioner that he filed Crl.M.P.No.75 of 2018 before the Special Sessions Judge for Trial of SCs & STs Cases-cum-VIII Additional Sessions Judge, Ananthapuram, wherein the learned Sessions Judge granted anticipatory bail by order dated 06.02.2018, while directing the petitioner to surrender before the Additional Judicial Magistrate Of First Class, Kadiri, on or before 19.02.2018 and execute a bond for a sum of Rs.25,000/- with two sureties for the like sum each to the satisfaction of the learned Magistrate, But he could not surrender before the learned Magistrate as surety forms were torn by the Advocates who were on strike on 19.02.2018, and the petitioner filed another application in Crl.M.P. No.155 of 2018 in Crl.M.P.No.75 of 2018 before the learned Sessions Judge to extend the time to surrender before the learned Magistrate and to produce sureties before the learned Magistrate, but the learned Sessions Judge dismissed the petition on the ground that the cause shown by the petitioner is not genuine.

MSM, J CRLP_3565_2018 - 2 - Taking into consideration of the facts and circumstances of the case and taking the judicial notice of abstaining from duties by Advocates, the time is extended for a week to surrender before the Additional Judicial Magistrate of First Class, Kadiri.
