THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2184 of 2015 ORDER:

This Criminal Revision Case is filed by the petitioner aggrieved by the order dated 15.07.2015, in I.A.No.417 of 2014 in F.C.O.P.No.854 of 2014 passed by the Judge, Family Court - cum - V Additional District and Sessions Judge, Visakhapatnam.

2. The 1st respondent, who is the wife of the petitioner, filed the above F.C.O.P. on her behalf and on behalf of her daughter against the petitioner claiming maintenance to her and to her daughter. During the pendency of the above F.C.O.P., the 1st respondent-wife also filed the above I.A. seeking to grant interim maintenance of Rs.3,000/- per month to her and to her daughter each. The learned trial Judge allowed the petition directing the petitioner to pay an amount of Rs.3,000/- per month to the 1st and 2nd respondents each from the date of filing of the petition. Aggrieved by the same, the petitionerhusband filed the present revision.

3. Heard and perused the material available on record.

4. There is no dispute as to the relationship between the parties. In view of the same and in view of the pendency of the main case, without expression any opinion on the merits of the case, this Criminal Revision Case is disposed of with the following direction:

i) The petitioner is directed to pay Rs.1,500/- per month to the 1st and 2nd respondents each towards interim maintenance on or before 10th of every succeeding month till disposal of the above F.C.O.P.;

ii) the petitioner is directed to pay the arrears of maintenance at the rate fixed by this Court from the date of filing of the petition i.e., I.A.No.417 of 2014 within a period of three months from the

date of receipt of a copy of this order; and iii) the trial Court is directed to dispose of the above O.P., as expeditiously as possible preferably, within a period of three (3) months from the date of receipt of a copy of this order, without being influenced by the above order.

5. Miscellaneous petitions pending, if any, in this Criminal Revision Case shall stand closed.
