THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.34261 of 2016 ORDER :

Petitioner apprehends that even though the request for shifting of the location of retail out let is opposed by the department, the 5th respondent is making efforts to shift the location which would adversely affect the business interest of the petitioner.

Learned counsel for the petitioner placed reliance on the letter dated 21.09.2016 addressed by the Station House Officer, Husnabad, to the Prohibition and Excise Superintendent, and contend that the Station House Officer, reported not to accept the request for shifting of the premises of the 5th respondent, as it would affect the business interest of the petitioner and other shop owners.

The said report is in favour of the petitioner. There is no other material to show that a contrary view is taken or without an order being passed by the competent authority, the 5th respondent shifted the premises of his retail outlet. Thus, the cause in the writ petition is pre-mature. Neither an order is passed for shifting of the premises nor the 5th respondent shifted the premises without an order.

Accordingly, the Writ Petition is dismissed. However, it is open to the petitioner to avail appropriate remedies as available in law, if any decision is made in favour of the 5th respondent. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
