THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SMT. JUSTI CE ANI S WRI T PETI TI ON No. 2027 of 2017 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) This writ petition is filed seeking implementation of the order dated 26.08.2016 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No. 7174 of 2014. By the said order, the Tribunal set aside the proceedings dated 29.11.2013 issued by the Superintendent of Police, Khammam District, removing the petitioner herein from service, and the order in appeal dated 17.04.2014 passed by the Deputy Inspector General of Police, Warangal Range, Warangal, confirming the same and directed the authorities to consider the request of the petitioner for modification of the penalty to that of compulsory retirement in view of his ill health.
Appropriate orders were directed to be passed within a period of eight weeks from the date of receipt of a copy of the order. Learned Government Pleader for Services (Telangana) concedes that no writ petition was filed by the authorities in relation to the aforestated order. He would further state that the Superintendent of Police, Khammam District, already addressed a communication to the Deputy Inspector General of Police, Warangal Range, Warangal, and the matter is in process.
This being the situation, we are of the opinion that it is not open to the authorities to turn a blind eye to the time stipulation fixed by the Tribunal when they have not chosen to challenge the order. The Writ Petition is accordingly disposed of directing the authorities to abide by and implement the order dated 26.08.2016 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No. 7174 of 2014, within eight weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
