THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI APPEAL SUIT No.1895 of 1999 JUDGMENT:

There was no representation for the appellants on 24.03.2017 and 26.04.2017. On 26.04.2017, noting the presence of the learned counsel for the respondent, the matter is directed to be posted on 22.01.2018. On that day also, the learned counsel for the respondent was present. However, there was no representation for the appellants. Hence, this Court directed the matter to be posted on 06.02.2018 under the caption "for dismissal". On 06.02.2018, when a request was made on behalf of the learned counsel for the appellants, the matter was directed to be listed today i.e., 08.02.2018, under the same caption. Today, there is no representation for the appellants. Learned counsel for the respondent is present. The above conduct of the appellants indicates that they are not interested in prosecuting the Appeal Suit. 2.

In the result, the Appeal Suit is dismissed for default. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.

There shall be no order as to costs.
