THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.20755 of 2016 O R D E R:

Petitioners' grievance is that petitioners have purchased the subject premises under registered sale deed dt.23.12.2015 from one Challa Kotamma, that they had applied on 07.01.2016 to the 4th respondent to mutate their names in the municipal records in the place of their vendor, and that the respondents 4 and 5 have not taken any action on the said application.

2. Sri N.Praveen Kumar, Standing Counsel for 4th respondent, states that there is a litigation initiated by the sons of the vendor of the petitioners, because of which, the 4th respondent has not take any action on the petitioners' application.

3. It is not the case of the 4th respondent that there is any injunction restraining the respondents 4 and 5 from making any mutation of the name of the petitioners. When the petitioners have shown prima facie title by producing the registered sale deed, merely because the sons of the vendor of petitioners have objected to the mutation, the 4th respondent is not entitled to refuse mutation of the name of the petitioners.

4. Therefore, the respondents 4 and 5 are directed to mutate the names of the petitioners in the municipal records in the place of their vendor within a period of four (04) weeks from the date of receipt of a copy of this order. It is made clear that this mutation would be subject to any civil litigation which the sons of the vendor of the petitioners initiate against the vendor of the petitioners and the petitioners.

5. Accordingly, the Writ Petition is allowed. There shall be no order as to costs.

6. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
