HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3417 OF 2017 ORDER:

The case of the petitioners is that 5th respondent filed an application before the 2nd respondent for mutation of his name in revenue records in respect of the land admeasuring Ac.0-23 gts basing on the order dated 25.07.2013 passed by the Junior Civil Judge, Nirmal in O.S.No.67 of 2004, who inturn directed the 4th respondent to implement the same. Accordingly, the 4th respondent issued notice dated 20.01.2017 to the petitioners. Though the appeal filed by the petitioners in A.S.No.14 of 2013 against the judgment and decree in O.S.No.67 of 2004 is pending, the 4th respondent entertained the application filed by the 5th respondent. Aggrieved by the same, the present writ petition is filed.

Heard the learned counsel for the petitioners. Learned Assistant Government Pleader for Revenue submits that the petitioners filed the writ petition on apprehension that the 4th respondent would consider the application of the 5th respondent without considering their objections. He also submits that the impugned proceedings are only notice and to which the petitioners have already filed objections.

It is to be seen that the writ petition is filed on apprehension. Having issued notice, the 4th respondent has to consider the objections of the petitioners before taking action on the application of the 5th respondent.

With the above observation, the writ petition is disposed of. No costs. Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
