THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.9917 OF 2011 O R D E R :
The case of the petitioner is that he is the Upa-Sarpanch of Tirumalagiri Gram Panchayat, Tirumalagiri Mandal, Nalgonda District and the 4th respondent is the Sarpanch. While so, the petitioner filed W.P.No.2261 of 2011 challenging memo dated 28.08.2010 issued by the 2nd respondent and this Court disposed of the same on 07.02.2011 directing the petitioner to make a representation to the 1st respondent. Accordingly, the petitioner submitted a representation dated 08.03.2011 before the 1st respondent requesting him to cancel the memo dated 28.08.2010. But the 1st respondent has not initiated any action against the 4th respondent. Aggrieved by the same, the present writ petition is filed.
Sri B.Vijaysen Reddy, learned counsel for the petitioner submits that the term of the 4th respondent has expired, as such, the cause in the writ petition does not survive and seeks liberty to pursue his remedies against the 4th respondent for the alleged irregularities committed by him. In view of the above, the writ petition is dismissed as infructuous giving liberty to pursue alternative remedies against the 4th respondent. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
