THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN TRANSFER CRIMINAL PETITION No.265 OF 2013 ORDER:

This is an application for transfer of C.C.No.55 of 2013 from the Court of the I Additional Special Judge for SPE & ACB Cases at Hyderabad, to the Court of the Special Judge for SPE & ACB Cases at Vijayawada.

Heard both sides.

The learned counsel for the petitioner submits that the petitioner as well as the majority of the witnesses are residing in the jurisdiction of the Special Judge for SPE & ACB Cases at Vijayawada and the properties allegedly acquired by the petitioner are also located in the jurisdiction of the said Court and therefore, he prays this Court to transfer C.C.No.55 of 2013 from the Court of the I Additional Special Judge for SPE & ACB Cases at Hyderabad, to the Court of the Special Judge for SPE & ACB Cases at Vijayawada.

Having regard to the facts and circumstances of the case, it is required that C.C.No.55 of 2013 from the Court of the I Additional Special Judge for SPE & ACB Cases at Hyderabad, to be transferred to the Court of the Special Judge for SPE & ACB Cases at Vijayawada. 5.

In the result, the Transfer Criminal Petition is allowed transferring C.C.No.55 of 2013 from the Court of the I Additional Special Judge for SPE & ACB Cases at Hyderabad, to the Court of the Special Judge for SPE & ACB Cases at Vijayawada.
