THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY CONTEMPT CASE No.699 of 2019 ORDER:

This court vide order dated 22.05.2019 in I.A.No.1 of 2019 in W.P.No.10541 of 2019 directed respondents not to interfere and demolish the structure erected by the petitioner in the subject property without following due process of law. For non-compliance of the aforesaid order, the present contempt case has been filed by the petitioner alleging that respondents are interfering in violation of orders dated 22.05.2019 of this Court.

A counter affidavit has been filed stating that one Sri Manne Kumar S/o Sri Chalapati Rao, has made a complaint on 05.06.2019 at 21:16 hours stating that the petitioner is digging bore well at H.No.5-104 Rayadur Pan Makta, thereby creating lot of nuisance and sound pollution. Acting on the said complaint police has registered a case in Crime No.363 of 2019 for the offences punishable under Section 290, 188 of Indian Penal Code r/w Section 70B of City Police Act. Vide STC No.1413 of 2019 on the

file of the XV Metropolitan Magistrate Rajendra Nagar and summons were issued and the said case is pending for adjudication. Since the respondents have followed due procedure before initiating any action as directed by this Court, there is no wilful violation on the part of the respondents to invoke the provisions of Contempt of Courts Act.

Accordingly the contempt case is closed. No costs. As a sequel, miscellaneous applications pending if any, shall stand closed.
