HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8639 of 2016 ORDER:

This petition is filed by the petitioner - Accused No.3 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail to him in Crime No.357 of 2015-16 of Prohibition & Excise Station, Chinthapalli, Visakhapatnam District, registered for the offence punishable under Section 8 (c) r/w.20 (b) (ii) of NDPS Act. Heard and perused the material available on record. The allegation against the petitioner is that he along with the other two accused, found in illegal possession of 70 kgs., of ganja. Since the ganja seized in the above case is commercial quantity, this Court is not inclined to grant bail to the petitioner.
