THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 2958 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioners/Accused Nos.2 and 3 on bail in connection with Crime No.1995 of 2021 on the file of Cyber Crime Police Station, Detective Department CCS, Hyderabad registered for the offence punishable under Section 66 read with Sections 43, 67 (A) of Information Technology Act (I.T.Act) and Sections 354(D), 384, 420 and 506 of Indian Penal Code (I.P.C).

Heard the learned counsel for the petitioners/Accused Nos.2 and 3 and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

Petitioners are arrayed as Accused Nos.2 and 3 in the aforementioned Crime registered for the offence under Section 66 read with Sections 43, 67 (A) of IT Act and Sections 354(D), 384, 420 and 506 of IPC.

The allegations against the petitioners/Accused Nos.2 and 3 are that they are the Directors of companies which launched Loan Apps and after giving loans to customers, the said customers are being fleeced for higher interest and also indulging in threatening the borrowers in several ways.

The petitioners were arrested on 08.03.2022 and also taken into police custody for a period of two days i.e. on 18.03.2022 and 19.03.2022. Since the remand report shows that nine witnesses are examined and the investigation is almost complete. In the said circumstances, this court is inclined to grant bail to the petitioners/Accused Nos.2 and 3 6.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.2 and 3 are granted bail subject to the following conditions:

i) The petitioners/Accused Nos.2 and 3 shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh Only) each with two sureties for a like sum each to the satisfaction of XII Additional Chief Metropolitan Magistrate, Nampally at Hyderabad.

ii) The petitioners/Accused Nos.2 and 3 shall appear before the Cyber Crime Police Station, Detective Department CCS, Hyderabad on every Wednesday and Sunday between 08.00 AM and 11.00 AM for a period of three (03) months or till filing of the charge sheet, whichever is earlier.

iii) The petitioners/Accused Nos.2 and 3 shall surrender their Passports with the XII Additional Chief Metropolitan Magistrate, Nampally at Hyderabad.

iv) The petitioners/Accused Nos.2 and 3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 7.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
