HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.13478 of 2005 ORDER:

This Writ Petition is filed against the order dated 02.02.2005 passed in S.A.No.6/2003 by the Authority Under Section 48 (3) of A.P.Shops and Establishments Act, 1988 & Deputy Commissioner of Labour, Hyderabad, modifying the order dated 02.06.2003 passed by the Assistant Commissioner of Labour, Hyderabad-III, in S.E.No.1/02, and awarding an amount of Rs.40,000/- towards compensation to the workman.

2. Heard. Perused the record.

3. When the matter is taken up for hearing, both the counsel agreed that this Writ Petition can be closed if the third respondent-Manager, Filmnagar Cultural Centre, Hyderabad, pays a sum of Rs.75,000/- to the petitioner in lieu of the compensation of Rs.40,000/- as awarded by the second appellate authority vide order dated 02.02.2005.

4. In view of the same and to meet the ends of justice, the compensation of Rs.40,000/- awarded by the second appellate authority is hereby enhanced to Rs.75,000/- payable to the petitioner by the third respondent, within a period of four weeks from the date of receipt of a copy of this order. It is made clear that the amount of Rs.75,000/- enhanced by this Court, is in addition to the amount already deposited by the third

AKS, J W.P.No.13478 of 2005 respondent towards 1/3rd backwages pursuant to the order dated 02.06.2003.

5. With these observations, the Writ Petition is disposed of.
