HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3587 OF 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings against him in Cr.No.9 of 2018 of Bheemini Police Station, Mancherial District, registered for the offences under Sections 420, 488, 487 and 120 (b) of I.P.C. Investigation is reported to be pending.

The complaint allegations briefly are that on 21-2-2018, on the information that duplicate cotton seeds are being sold and transported, the Agricultural Extension Officer (AEO) Bheemuni Mandal passed information to the Revenue and Police Departments and proceeded along with R.I and H.C.1531 and P.C.2064 to Peddapeta village X Roads and there, they found A.3 standing with two gunny bags with print as Pavani Seeds. On enquiry, they came to know that he was carrying spurious cotton seeds. In each bag, there were 60 packets, each weighing 450 grams. On enquiry, A.3 revealed that he purchased those seeds from A.1 and A.2. Investigation is reported to be pending.

Having regard to the strong prima facie case and investigation is in initial stage, it is not a fit case to quash the proceedings. Therefore, investigation shall proceed to its logical conclusion. However, having regard to the nature of offence, the Investigating Officer shall strictly follow the procedure contemplated under Section 41-A Cr.P.C. during the course of investigation. The

petitioner is directed to cooperate with the Investigating Agency for smooth completion of investigation.

This Criminal Petition is disposed of accordingly. As a sequel, miscellaneous applications pending if any, shall stand closed.
