HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.11633 OF 2019 ORDER:

This writ petition is filed challenging the action of the 2nd respondent in seizing the petitioner's TATA Goods Carriage bearing No.AP 23 Y 2920 without following procedure.

When the matter was listed on 17-06-2019, this Court passed orders as under:

" Learned Assistant Government Pleader for Home on instructions submits that, during investigation, the petitioner's vehicle is involved in hit and run case and the same is registered as Crime No.95 of 2019 on 22-04-2019. This aspect came into light through CC TV footage. He further submits that the Motor Vehicle Inspector is asked to inspect the vehicle and within a week the inspection will be over and the vehicle will be produced before the concerned Court."

Learned Assistant Government Pleader again today says that letter is addressed on 03-06-2019 to the Motor Vehicle Inspector for inspection of the vehicle. It is to be seen that though subject vehicle was seized on 22-04-2019, it is not known why the respondents are taking such a long time. In view of the same, the 2nd respondent is directed to take appropriate action for production of the subject vehicle before the concerned Court enabling the petitioner to take appropriate action to obtain relief in the concerned Court.

Accordingly, the writ petition is disposed of directing the 2nd respondent to get the subject vehicle checked and take action for producing the same before the concerned Court within a period of two weeks from date of receipt of copy of this order and thereafter, it is open for the petitioner to make application before the concerned Court for release of the subject vehicle.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 24-06-2019 Nvl
