THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.9987 of 2015 ORDER:

This Criminal Petition under Section 482 of Cr.P.C., is filed by the petitioner/accused seeking to quash the proceedings in S.T.C.No.429 of 2015 on the file of XII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, registered for the offences under Section 3 of Motor Transport Workers Act, 1961 read with Rule 13, 28, 30, 38, 24(1), 24(2), 35(A), 33,34,35,36 and 37 of the Andhra Pradesh Motor Transport Workers Rules, 1963, against him. 2.

Heard learned counsel for the petitioner/accused, learned Additional Public Prosecutor representing the 1st respondent-State and perused the record.

Though the petitioner has raised several grounds to quash the proceedings in the aforesaid case, learned counsel for the petitioner requested this Court to dispense with the appearance of the petitioner/accused in the aforesaid case before the trial Court. 4.

Learned Additional Public Prosecutor submits that since the identity of petitioner is not in dispute, his presence in the above case may not be necessary on every date of adjournment. 5.

In view of the aforesaid submissions, the appearance of the petitioner/accused in S.T.C.No.429 of 2015 on the file of XII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, is dispensed with, except on the dates whenever his presence is required by the trial Court and he shall be represented by his counsel.

With the above direction, the Criminal Petition is disposed of. 7.

Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
