THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.11822 of 2015 ORDER:

This petition is filed under Section 482 Cr.P.C. to quash the proceedings against the petitioner/A1 in C.C. No.425 of 2008 on the file of the Court of Judicial First Class Magistrate, Narayanapet, Mahabubnagar District.

2. The learned counsel for the petitioner/A1 has sought permission of this court to permit the petitioners to withdraw the criminal petition with liberty to avail all the remedies available to him under law including filing of petition under Section 70 (2) Cr.P.C. Permission is granted.

3. Accordingly, the criminal petition is dismissed as withdrawn granting liberty as prayed for. If the petitioner files petition under Section 70(2) Cr.P.C., to recall N.B.W., issued against him, the trial Court shall dispose of the same on the same day in accordance with law. Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
