Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 3.
This Writ Petition is filed seeking to declare the action of the 3rd respondent in taking steps to sell the seized stocks of paddy, rice and broken rice worth of Rs.21,13,250/- of the petitioner in pursuance of the order dated 9.3.2015 passed by the 2nd respondent as arbitrary and illegal.
The petitioner is the partner of M/s. Sri Raja Rajeshwari Rice Mill, Pedda Golconda Village, Shamshabad Mandal, Ranga Reddy District. On 15.11.2014, the Civil Supply Authorities inspected the rice mill of the petitioner, seized paddy, rice and broken rice on the allegation that the petitioner was not maintaining the records properly. Thereafter, a case under Section 6-A of the Essential Commodities was filed before the 2nd respondent-District Collector, Ranga Reddy District, who in turn, passed order dated 9.3.2015 confiscating the entire seized stock worth Rs.21,13,250/-. Feeling aggrieved, the petitioner preferred an appeal along with stay application before the Principal District & Sessions Judge, Ranga Reddy District, at L.B.Nagar.
Learned counsel appearing for the petitioner submits that the stay application filed by the petitioner seeking suspension of the order passed by the District Collector, was posted to 28th April, 2015. He further submits that if the said application is not disposed of at an early date, the confiscated stock will be sold by the
respondent-authorities.
Under these circumstances, the learned Principal District & Sessions Judge, Ranga Reddy District, is directed to advance the hearing of the said stay application to an early date and pass appropriate orders within an period of two weeks from the date of receipt of a copy of this order.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
