HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT APPEAL No. 525 of 2018 JUDGMENT: (per the Hon'ble Sri Justice A. Rajasheker Reddy) This Writ Appeal is filed against order dated 25.01.2018 wherein and whereby learned Single Judge dismissed Writ Petition No.4547 of 2006 filed by appellant challenging orders passed by revenue authorities under the provisions of Telangana Rights in Land and Pattadar Pass Books Act, 1971, on the ground of delay in filing appeal.

Learned counsel for appellant submits that immediately after coming to his notice that mutation was granted in favour of respondent No.1 with respect to subject land, appellant filed appeal questioning such mutation, but, learned Single Judge without considering the said aspect, passed order impugned dismissing aforesaid Writ Petition.

Heard learned counsel for respondent No.1.

A perusal of order impugned goes to show that learned Single Judge rightly observed that appellant filed appeal nine (9) years after granting mutation in favour of respondent No.1 with regard to subject land without assigning any reason or producing any documentary evidence to show that his mother succeeded to

HCJ & ARR, J W.A.No.525 of 2018 subject land; appellate authority by considering the said aspect, dismissed such appeal as time barred and revisionary authority also rejected revision on same ground. In view of same, we do not find any error or infirmity in order impugned, as such, we are not inclined to entertain this Writ Appeal.

Accordingly, this Writ Appeal is dismissed. However, it is open for appellant to avail alternative remedies as available to him under law in accordance with law.

Pending miscellaneous petitions, if any, shall also stand dismissed. There shall be no order as to costs. ___________________________________ THOTTATHIL B. RADHAKRISHNAN, CJ Date: 25.03.2019 ________________________ A. RAJASHEKER REDDY, J kvni
