This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioner/respondent seeking to quash the proceedings against the petitioner in the order, dated 01-08-2016 passed in Crl.M.P.No.222 of 2015 in M.C.No.12 of 2012 on the file of the Principal Judicial First Class Magistrate, Sompeta, Srikakulam District. Heard the learned counsel for the petitioner/respondent and the learned Public Prosecutor and perused the material available on record. Considering the facts and circumstances of the case, the Criminal Petition is disposed of directing the petitioner/respondent to file appropriate application before the Court below for the relief and on filing of such application, the Court below shall consider the same on its own merits. Miscellaneous petitions pending in this petition, if any, shall stand closed.
