THE HON'BLE JUSTICE G.SRI DEVI Criminal Petition No.3105 of 2019 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused No.6 seeking to quash the proceedings in C.C.No.233 of 2017 on the file of the Judicial First Class Magistrate, Achampet, for the offence punishable under Sections 498A read with 109 IPC.

2. Though the present Criminal Petition is filed seeking quashing of further proceedings in the abovesaid Calendar Case, at the time of hearing, learned counsel for the petitioner restricts his prayer seeking dispensation of the presence of the petitioner before the trial Court.

3. The learned Additional Public Prosecutor submits that since the question of identity of the petitioner does not arise in the present case, his presence in the above C.C. may not be necessary on every date of adjournment.

4. Having regard to the facts and circumstances of the case and considering the rival submissions, the personal appearance of the petitioner in C.C.No.233 of 2017 on the file of Judicial First Class Magistrate, Achampet, is hereby dispensed with except on the dates specifically required by the trial Court.

5. Accordingly, the Criminal Petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
