HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.205 of 2014 ORDER:

There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as under: "... to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the 3rd respondent police in not releasing the petitioner vehicle bearing No.AP 02 TB 1719 as per the release order dated 11.12.2013 passed by the 2nd respondent is illegal, arbitrary, highhanded and violation of principles of natural justice and consequently direct the 3rd respondent to release the petitioner vehicle bearing No.AP 02 TB 1719." Learned Government Pleader appearing for the respondents placed on record the written instructions dated 29.08.2019 issued by the Assistant SubInspector of Police, Thirumalayalapalem Police Station, Khamman District and the same is taken and placed on record.

From a perusal of the said written instructions, it is revealed that as per the directions of this Court the vehicle was released. It is further stated that one M.Nagendra Babu has taken the custody of the vehicle on 24.12.2013 from the Station House Officer, Thirumalayapalem, stating that the owner of the vehicle Marugu Gopal Reddy, S/o. Sanjeev Reddy, R/o. Anantapur District has given him an authorization letter to take custody of the vehicle. To prove the release of the said vehicle, the receipt issued by the said M.Nagendra Babu for giving custody of the vehicle is enclosed to the written instructions. In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be dismissed. Accordingly, the writ petition is dismissed. No order as to costs. Miscellaneous petitions, if any, shall also stand dismissed. ___________________ P. KESHAVA RAO, J Date: 03.09.2019.
