THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION NO.22150 OF 2006 ORDER:

The proceedings under challenge in this Writ Petition is the memo dated 14.09.2006 informing the petitioner that her claim to be a member of the Scheduled Tribe was doubtful; the District Collector, Visakhapatnam was being requested to cause a detailed enquiry by placing the matter before the District Level Scrutiny Committee; and the action taken in this regard should be sent by the District Collector to the Registrar, NTR University of Health Sciences, Vijayawada.

On the petitioner approaching this Court, an interim order was passed in WP.MP.No.28120 of 2006 on 30.10.2006, directing the respondents to consider the petitioner's case for admission into the MBBS course under the quota reserved for the Scheduled Tribes, after considering her case as per the rank secured by her. Sri V.Sreenivasa Rao, learned counsel for the petitioner, would submit that the petitioner joined the MBBS course pursuant to the interim order passed by this Court. While no counter affidavit has been filed by the respondents, learned Government Pleader for Social Welfare has placed before this Court a copy of the letter addressed by the District Collector, Visakhapatnam dated 27.10.

2006, stating that the Mandal Revenue Officer, Ananthagiri had verified the records, and had found that the petitioner belongs to 'Konda Dora' Scheduled Tribe; and her claim to be a member of Scheduled Tribe was genuine.

The Writ Petition is, accordingly, closed. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
