This Writ Petition has been filed questioning the action of Respondents 2 and 3 in proposing to lay the road from the house of the petitioner, without issuing any notice and without following the due process of law.
The petitioner claims to be the owner and possessor of house property in Survey No. 926 situated at Madakalavaripally Village, Gopavaram Mandal, Y.S.R. Kadapa District. Now, Respondents 2 and 3, without there being any necessity, are proposing to lay the road from the subject property, without following the procedure prescribed therefor, is the main grievance of the petitioner in this Writ Petition.
Heard learned counsel for the petitioner and Sri S.D. Goud, learned Standing Counsel for the respondent Municipality. In view of the relief sought for by the petitioner, the Writ Petition is disposed of directing the respondent authorities to follow the due procedure established under law, if the property of the petitioner is required for the purpose of laying a road. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
