THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.36969 OF 2013 ORDER:

Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for the respondents 1 to 3.

The prayer sought in the Writ Petition reads as under:- "...to issue an order or direction, more particularly in the nature of Writ of Mandamus to declare the impugned notice vide proceeding No.728/A1/Cyb/13, dt. 13.12.2013 issued by respondent No.3 is arbitrary, illegal and violation of principles of natural justice and fundamental rights and set-aside the same and consequent direction to the first respondent to consider the representation of the petitioner firm dt. 14.12.2013 for issuance of no objection certificate to run the petitioner club and pass such other order or orders as deemed fit in the circumstance of the case and in the interest of justice."

During the course of hearing, the learned Government Pleader for Home placed on record the written instructions dated 16.09.2019 issued by the Sub-Inspector of Police, Jawharnagar Police Station, Rachakonda Comissionerate.

A perusal of the said written instructions would indicate that on enquiry they came to know that the petitioner-Club is not running and the same was seized by the Assistant Recovery Company.

The learned counsel appearing for the petitioner also submits that no further orders are required in the Writ Petition.

Having regard to the said submissions made by both the counsel, this Court is of the opinion that no further cause would survive in the Writ Petition and the same is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs. Miscellaneous applications, if any, pending shall stand dismissed.
