THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.6192 of 2013 ORDER:

The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings against A1 and A2/petitioners herein in Cr.No.238 of 2012 of Tiruvuru Police Station, Krishna District. Learned counsel for the petitioners submits that the 1st petitioner/A1 died and a perusal of the complaint clearly goes to show that absolutely no allegations are levelled against the surviving accused viz., A2.

On the other hand, the learned Additional Public Prosecutor submits that after completion of investigation, police have filed chargesheet and the same is numbered as C.C.No.221 of 2015. In view of the above submission, the learned counsel for the petitioners seeks permission of this Court to withdraw this Criminal Petition with a liberty to file fresh Criminal Petition, if the petitioner/A2 is so advised.

Permission is accorded.

Accordingly, the Criminal Petition is dismissed as withdrawn giving liberty as prayed for.

Pending miscellaneous applications, if any, shall stand closed in consequence.
