ORDER:

The petitioner, who is related to the judgment debtor and who filed claim petition in the execution petition filed by the decree holder, has filed this revision petition feeling aggrieved by the order, dated 26.10.2015, in E.A.No.106 of 2015 in E.A.No.134 of 2013 in E.P.No.48 of 2009 in O.S.No.275 of 2005 filed by her for appointing an Advocate Commissioner for her cross-examination.

A perusal of the medical certificate filed by the petitioner shows that as on the date of issue of the said certificate, the petitioner was bed ridden for three to four months. The medical certificate does not show that she has impairment for future also and that there is not chance of her regaining mobility. In my opinion, the petitioner, having filed the claim petition, it is desirable that she attends the Court and gives her evidence.

In the above circumstances, I do not find any reason to interfere with the order of the lower Court, dismissing E.A.No.106 of 2015. The Civil Revision Petition is accordingly dismissed. As a sequel to dismissal of the civil revision petition, C.R.P.M.P.No.6887 of 2015 filed by the petitioner for interim relief shall stand dismissed as infructuous.
