HON'BLE SRI JUSTICE C.V.BHASKAR REDDY CONTEMPT CASE No.1162 of 2018 O R D E R:

This Contempt Case is filed alleging violation of orders dated 28.11.2017 passed by this Court in W.P.No.39726 of 2017. 2.

By the above said order, this Court has directed the Assistant City planner, Circle No.4, Greater Hyderabad Municipal Corporation, to consider and dispose of the representation dated 23.10.2017 submitted by the petitioner, strictly in compliance with the procedure established by law, after giving an opportunity of hearing to the respondent Nos.4 to 7 and communicate the decision taken thereon as and when taken within a week thereafter to the petitioner.

Learned Counsel appearing for the petitioner has submitted that petitioner has not placed any latest instructions so far as the disposal of the writ petition is concerned.

Learned Standing Counsel appearing for the respondentCorporation submits that in compliance of the orders of this Court dated 28.11.2017, the respondent-officials have inspected the premises of the respondent Nos.4 to 7 and having noticed the illegal Constructions, they have initiated an action for removal of illegal Constructions by issuing

notice under section 452 (1) and 461(1) of Greater Hyderabad Municipal Corporation Act, 1955, dated 28.12.2017 and questioning the said notice, the respondent Nos.4 to 7 have instituted O.S.No. 2234 of 2017 on the file of VI Junior Civil Judge, City Civil Court, Hyderabad and obtained interim orders of status quo in I.A.No.696 of 2017 dated 18.09.2017 and according to his information, the said suit is still pending and soon after the disposal of the said suit, they will strictly initiate the action for removal of illegal constructions being carried on by the respondent Nos.4 to 7 strictly in accordance with the provisions of the GHMC Act, 1955.

Recording the above submission of the learned standing Counsel, the Contempt case is closed as no further orders are necessary. Miscellaneous petitions, if any pending in this contempt case shall stand dismissed.
