THE HON'BLE DR. JUSTI CE SHAMEEM AKTHER CI VI L REVI SI ON PETI TI ON No.1 3 9 8 OF 2 0 1 9 ORDER:

This revision, under Article 227 of the Constitution of India, is filed by the petitioner-husband aggrieved by the order dated 15.04.2019 passed in I.A.No.410 of 2018 in O.P.No.260 of 2017 by the learned I Additional Family Court-cum-IV Additional District Judge, Ranga Reddy District at L.B. Nagar, wherein the respondents-wife and son were granted interim maintenance of Rs.7,000/ - per month from May 2019 onwards.

2.

Heard learned counsel for the revision petitioner-husband and perused the record.

3.

Learned counsel for the revision petitioner-husband would contend that the interim maintenance granted by the Court below is excessive. The revision petitioner-husband is a daily wage electrician and he has no capacity to pay the said amount and ultimately prayed to reduce the same.

4.

There is no dispute with regard to the relationship between the parties. The Court below directed the petitioner-husband to pay the maintenance of Rs.7,000/ - per month to the respondents from May 2019 onwards although the FCOP is pending from 2017 onwards. The contention of the learned counsel that the revision petitioner being an electrician does not earn much money and he cannot pay the interim maintenance of Rs.7,000/ - per month is unacceptable. There is material to show that the petitioner-husband has sufficient means to maintain his

wife and son. It is pertinent to state that now-a-days, the cost of living is very high. More expenses are being incurred to pursue any education. Hence, granting of interim maintenance at Rs.7,000/ - per month is not excessive. There is no merit to vary the impugned order. There is no infirmity in the impugned order. The Court below is justified in granting the said amount. Under these circumstances, the Civil Revision Petition is devoid of merit and is liable to be dismissed.

5.

In the result, the Civil Revision Petition is dismissed at the stage of admission.

The Miscellaneous Petitions, if any, pending shall stand closed. No costs.
