This is a case where the impugned sale notice is dated 07.05.2019. But the possession notice under Section 13(4) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, is dated 11.05.2019. Thus, this is a case of putting the cart before the horse.

Learned counsel for the respondent bank submits that the bank has cancelled the auction scheduled to be held today. In view of the said submission, the writ petition is closed. Consequently, pending miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
