THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.17655 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed questioning the proceedings in Rc.No.3/81/2017 dated 22.02.2017 whereby the 3rd respondent ordered forfeiture of 195 days of ordinary remission and denied parole and furlough for a period of two years. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the authorities to consider his explanation dated 17.03.2017, wherein he explained the circumstances under which he over stayed after release on parole. Learned AGP submits that he has no objection for such a direction, if such a representation is still pending. Having regard to the above, the Writ Petition is disposed of directing the first respondent to deal with the representation submitted by the petitioner on 17.03.2017, if it is still pending, and pass appropriate orders thereon, as early as possible, preferably within a period of four weeks from the date of receipt of a copy of this order.
