The Criminal Appeal is allowed and the conviction and sentence inflicted by the III Additional Metropolitan Sessions Judge, City Criminal Courts, Hyderabad in SC No.243 of 2007 vide judgment dated 08.10.2007 for the offence punishable under Section 304-I IPC is set aside and the appellant - A1 is acquitted of the said offence. As the appellant - A1 is in judicial custody, he is directed to be released forthwith if he is not required in any other case/crime. Fine amount, if any, paid by the appellant - A1 shall be refunded to him. Bail bonds shall stand cancelled and the sureties are discharged.
