THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.23519 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of the respondents in initiating proceedings under Section 6A of the Essential Commodities Act, 1955 on the panchanama dated 29.10.2015 as illegal, arbitrary, improper and without any power or authority under law.

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.

Learned Government Pleader for Civil Supplies, on instructions, submitted that the District Collector, Krishna at Machilipatnam issued a memo on 18.07.2016 directing the petitioner to furnish a bank guarantee for an amount of Rs.49,45,800/- for release of the seized stock. He also filed the memo to that effect. In view of the submission made by the learned Government Pleader, no further orders are necessary in this writ petition. Hence, the Writ Petition is closed. No costs. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
