ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.51 of 2026 before the Thimmajipet Police

Station, Nagarkurnool District, registered for the offences punishable under Section 109(1), 132 of BNS.

The brief facts of the case are that on 17.03.2026, while the Revenue officials were on sand duty in RC Thanda village to prevent illegal transportation of sand, they noticed a tractor without a number plate transporting sand illegally. When they attempted to intercept the vehicle, the driver allegedly drove through agricultural fields, dumped the sand, and later, when approached, intentionally drove the tractor towards the officials, causing injury to one of them, and fled from the scene.

Heard Smt. Mogili Anaveni, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachander Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent and falsely implicated due to political rivalry, as he belongs to the opposition party and that the alleged offences are not attracted, as there was no intention to

cause injury and no grievous injury was sustained by the complainant. He further submitted that several tractors were operating illegally, but only the petitioner was targeted, and even as per the complaint, the vehicle is already in police custody, making the allegation of absconding untenable. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition. 5.

Learned Additional Public Prosecutor opposes the petition contending that the allegations are serious in nature, as the petitioner obstructed and attacked public servants while discharging their official duties and that the petitioner intentionally drove the tractor towards the officials causing injury and thereafter absconded, and therefore the offences are clearly made out. Therefore, at this stage, granting of prearrest bail to the petitioners does not arise. Hence, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the allegations against the petitioner arise out of an incident relating to alleged illegal

transportation of sand and obstruction of public servants while discharging their duties. The main allegation against the petitioner is that he drove the tractor in a rash manner and dashed against the revenue officials, causing injury, and thereafter fled from the spot. Considering the facts and circumstances of the case, including the nature of allegations, this Court deems it fit to grant pre-arrest bail to the petitioner subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Thimmajipet Police Station, Nagarkurnool District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, each with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., for a period of eight

(8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
