The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of Sri HARINADH NIDAMANURI, Advocate for the Petitioner, Additional PUBLIC PROSECUTOR the sole Respondent, the Court made the following.

ORDER:

ORDER

This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused, for grant of bail in Crime No.210 of 2019 of Ghatkesar Police Station, Medchal District, registered for the offences punishable under Sections 342, 354A of IPC and Section 12 of POCSO Act, 2012 and Section 75 of Juvenile Justice Act,2015.

Heard the learned counsel for the petitioner/accused, the learned Additional Public Prosecutor representing the respondent/State and perused the record.

The case of prosecution, in brief, is that on 02.05.2019, the de facto complainant, who is working as District Child Protection Officer, Medchal District conducted inspection of Children Care Institution (Friends Foundation), run by the petitioner and found that the petitioner/accused violated the orders of Child Welfare Committee and illegally confined ten girls.

Learned counsel for the petitioner/accused submits that the victims were sent to the safe custody of their respective parents and nothing is pending to investigate into the matter. He further submits that the petitioner started institution to provide good food and education to the poor students and is running the said institution since 2013 without any black mark and none of the parents have lodged any complaint against the petitioner till date. The petitioner has already sent some of the students r^ Ihair native places and some of the { :

students were waiting for arrival of their parents, but the de facto complainant has lodged the present complaint against the petitioner on false allegations and ultimately prayed to allow the petition.

5. Learned Additional Public Prosecutor representing the respondent/State opposed to grant bail to the petitioner/accused and ultimately prayed to dismiss the petition.

As per the material placed on record, the petitioner/accused is in judicial custody from 03.05,2019 and major part of the investigation is completed. Under these circumstances, without adverting to the merits of the case, this Court is inclined to grant bail to the petitioner/accused on certain terms and conditions.

Accordingly, the petitioner/accused is ordered to be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the IV Additional Metropolitan Magistrate-cum-IV Additional iunior Civil ludge, Cyberabad at L.B. Nagar. On such release, the petitioner/accused shall report before the Station House Officer, Ghatkesar Police Station, Medchal District, on every First Saturday before the concerned Police Station between 10:00 A.M. and 5:00 P.M. till filing of the charge sheet/final report. The petitioner/accused shall appear in-person before the trial Court on each and every date of hearing till completion of trial.
