THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 21090 of 2016 ORDER:

Heard learned counsel for the petitioner as well as learned Government Pleader for Civil Supplies (Andhra Pradesh). The petitioner is the fair price shop dealer of Hanumanapalli Village, Agali Mandal, Anantapur District. Her authorization was suspended pending inquiry, by proceedings of the 3rd respondent Revenue Divisional Officer, Penukonda, dated 19.05.2016, on the ground that there is variation (excess) in stock. It is this proceedings, which is challenged in this Writ Petition.

Since the allegations levelled against the petitioner are serious in nature, the truth or otherwise of the same can be ascertained only in the inquiry to be conducted by the respondent-authorities. Hence, without going into the merits of the matter, in my opinion, a direction to the 3rd respondent Revenue Divisional Officer to complete the inquiry within a fixed timeframe, would meet the ends of justice. In the instant case, the petitioner has not responded to the show cause notice dated 18.05.2016. Hence, two weeks' from today is granted to the petitioner to submit her explanation. Thereafter, within four weeks, the 3rd respondent shall conduct the inquiry and pass appropriate final orders, after taking into account the explanation that might be submitted by the petitioner, duly observing the principles of natural justice.

If the inquiry is not completed within the schedule fixed above, the authorization in favour of the petitioner shall stand restored till the 3rd respondent concludes the inquiry. With this order, the Writ Petition stands disposed of. No costs. Consequently, the Miscellaneous Applications, if any shall also stand disposed of.
