This Writ Petition is filed to declare the inaction of the official respondents, more particularly the 4th respondent against the illegal constructions over the land admeasuring Acs.6.01 guntas in Survey No. 504, Ac.1.07 guntas in Survey No. 505 situated in Atmakur Village and Mandal, Wanaparthy District as illegal and arbitrary.

Sri Ravi Chandra Bejjaram, learned counsel for the petitioner submits that the subject land is still agricultural land and without converting it into non-agricultural purpose, the same cannot be divided into plots. He submits that taking advantage of the inaction of the official respondents, Respondents No. 7 to 13 have created fake and fabricated layout and are making illegal construction over the land without approval of lay out. 3.

Sri N. Praveen Kumar, learned Standing Counsel for the respondent Municipality submits that there is a dispute with regard to the identity of the boundaries in two survey numbers and he seeks time to get instructions and file counter. 4.

However, in view of the submission of the learned Standing Counsel that there is a dispute with regard to the identity of the boundaries, the Writ Petition is disposed of directing

the respondent authorities to take appropriate action in accordance with law on the illegal constructions made by the unofficial respondents.

Consequently, the miscellaneous Applications, if any shall stand closed.
