Gurumuru Sai Kumar @ Sai @ Laddu ...

Petitioner/Accused No.4 And The State of Telangana, Rep by its Public Prosecutor, High Court for the State of Telangana, at Hyderabad, Through SHO, P.S Jagadgirigutta, Hyderabad.

... Respondent/Complainant : COMMON ORDER :

These criminal petitions are filed praying this Court to enlarge the petitioners on bail who are arrayed as accused Nos.2 to 4 in Crime No.1130 of 2025 before the Jagadgirigutta Police Station, registered for the offence punishable under Sections 103(1), 61(2) r/w. 3(5) of BNS.

2.

Brief facts of the case are that on 05.11.2025 at about 16:00 hours near Jagadgirigutta Bus Stop, Jagadgirigutta, the complainant Maturi Manohar lodged a report stating that while he and his friend Roshan Singh were alighting from a passenger auto, accused Bala Sow Reddy, Adhil, and Mahamood attacked Roshan Singh. It is alleged that Mahamood held Roshan's pant

- 3 - and instigated Bala Sow Reddy to stab him, whereupon Bala Sow Reddy repeatedly stabbed Roshan Singh with a knife, causing severe bleeding injuries on his stomach, chest, and back. Despite cries from the complainant and others, the accused continued the assault, and thereafter fled the scene on a bullet motorcycle. Roshan Singh was shifted to Meditech Hospital and later to Gandhi Hospital, where he succumbed to injuries.

3.

Heard Sri Bonthu Lokesh Phanindra Reddy, learned counsel appearing for the petitioners and Sri Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

4.

Learned counsel for the petitioners submitted that the petitioners are innocent, falsely implicated, and have no connection with the alleged offence. He contended that most of the investigation is completed, statements of witnesses recorded, and charge sheet filed. The petitioners/accused Nos.2 and 3 were remanded on 06.11.2025 and petitioner/accused No.4 was remanded on 12.11.2025, police custody was granted, and investigation concluded. He further submitted that no prima facie case is made out, that the complaint is mala fide, and that the petitioners hails from a respectable family, owns

- 4 - properties, and are ready to cooperate with the investigation. Hence, prayed this Court to grant bail to the petitioners. 5.

Learned Additional Public Prosecutor opposed the submissions stating that the complaint and investigation clearly reveal their active role in the offence, and that they, along with accused No.1, attacked and killed Roshan Singh with premeditated intention. He contended that the raid and subsequent investigation resulted in recovery of incriminating material, and that granting bail at this stage would hamper the prosecution case. As such, petitioners are not entitled for bail and prayed to dismiss these petitions.

6.

Having regard to rival submissions, and on perusing the material on record, it is noted that custodial interrogation of the petitioners is no longer required as investigation is completed and charge sheet filed. However, considering the gravity of allegations and the nature of offence, this Court is of the view that the petitioners are entitled to bail, subject to compliance with the following conditions:

i.

The petitioners shall execute a personal bond for a sum of Rs.25,000/- each

- 5 - (Rupees Twenty Five Thousand only, with two sureties for a like sum each to the satisfaction of the XIV Additional Judicial Magistrate of First Class, Medchal-Malkajgiri District, at Kukatpally.

ii.

The petitioners shall co‐operate with the trial and shall further remain present before the trial Court on each and every date of hearing.

iii.

The petitioners shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

7.

Accordingly, these Criminal petitions are allowed. Miscellaneous petitions, if any, pending shall stand closed.
