This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking the Court to grant anticipatory bail to the petitioner in the event of his arrest in connection with Crime No.975 of 2025 of Attapur Police Station, Cyberabad. The offences alleged against the petitioner are under Sections 140(1), 109(1), r/w.3(5) of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

The brief facts of the case are that on 14.11.2025 in the early morning, the complainant stated that his younger brother, Khaja Junaid, received a phone call from Anwar. Thereafter, Junaid along with his friend went and met Anwar near Pillar No.121 at Attapur at about 02:00 hours. It is alleged that Anwar, along with Sajid and Faisal, forcibly kidnapped Junaid in a maroon coloured Kia Car TS09GB1410. On hearing the commotion raised by Junaid, his friend followed the car on a two-wheeler for about 15 minutes and noticed that Mudassir was brutally assaulting him, while Sajid got down from the car on the way. Thereafter, Junaid's friend chased the car and intercepted it near Olive Hospital and immediately informed Dial-100 for police assistance.

The police started surveillance; apprehended Anwar, Faisal and Mudassir near Masab Tank and shifted them to the police station, while the injured Junaid was referred to Mahavir Hospital for treatment, where his condition was stated to be critical. It is further alleged that Junaid was a witness in an earlier case relating to his friend Abdus Sami, in which the accused persons were cited, and due to previous grudge they kidnapped, assaulted and threatened him. Basing on the said complaint police registered the case against the accused for the above offences.

Heard Sri Md. Saleem Ahmed Khan, learned counsel appearing for the petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent - State.

The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations and he is falsely implicated in this case. Further as per the FIR, the allegation against the petitioner is that he left the vehicle midway and that no specific overt acts are attributed to the petitioner and that the main allegation of brutal assault was committed by other accused and no material object was seized from the petitioner and that entire allegations are vague and omnibus in nature. Petitioner undertakes to abide by any conditions that may be imposed by this Court. Hence, prayed this Court to grant anticipatory bail to the petitioners.

On the other hand, the learned Additional Public Prosecutor opposed bail contending that the petitioner along with other accused is involved in this offence. He also informed that no other cases are registered against the petitioner. As

such, petitioner is not entitled to bail and prayed this Court to dismiss this petition.

Having considered the rival submissions and on perusal of the material available on record, this Court observes that the specific allegation against the petitioner, as seen from the FIR, is that he allegedly left the vehicle midway and no specific overt act of assault is attributed to him. The main allegation regarding physical assault appears to be against the other accused persons. Further, the injured is stated to have sustained only simple injuries and that no other crimes are registered against the petitioner as informed by learned Additional Public Prosecutor. Considering the allegations against the petitioner, this Court deems it fit to grant anticipatory bail to the petitioner subject to the following conditions :

i. The petitioner shall surrender before the Station House Officer, Attapur Police Station, Cyberabad District within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on his executing a personal bond for a sum of Rs.25,000/- (Rupees

Twenty Five Thousand only) with two sureties, for the like sum each.

ii. The petitioner shall appear before the concerned SHO between 09.00 a.m and 05.00 p.m., on every Monday for a period of eight (8) weeks, for the purpose of investigation or till filing of charge sheet whichever is earlier and thereafter, as and when required.

iii. The petitioner shall abide by the other conditions stipulated in Section 482 (2) of BNSS and cooperate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
