THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.24515 OF 2011 ORDER:

The petitioner's society is a registered society, which wanted to establish B.Ed., college in the name of Sarada College of Education and submitted an application through online on 30-09-2010 for grant of recognition for B.Ed., course for the academic year 2011-12. It was followed by another application, dated 06-10-2010 by hand and it was acknowledged. As the petitioner's society applied for B.Ed., course under minority status, the minority status certificate was not submitted along with the application as the State Government was issuing the said certificate only after making the application for recognition to any course.

However, the Government issued the minority status certificate on 01-02-2011. After receipt of the minority status certificate, another application was submitted to the respondent on 21-02-2011. But, the respondent did not communicate any decision. The respondent framed new regulations for recognition, which came into force w.e.f. 28-11-2014.

The Hon'ble Supreme Court in RASHTRASANT T.M.S. &S.B.V.M.C.A. VID. & ORS V GANGADAR NILKANT SHENDE & ORS (Special Leave to Appeal (Civil) Nos. 4247-4248/2009) held as follows: "Those who are desirous of establishing teacher education colleges/institutions shall be free to make application in accordance with the new regulations. Their applications shall be decided by the competent authority keeping in view the relevant statutory provisions. All the pending applications shall also be decided in accordance with the new regulations."

In view of the same, the respondent is directed to verify the record and if the application of the petitioner is pending, the same shall be processed as per the new regulations and if the application of the petitioner is not pending, a letter be issued to the petitioner so as to enable him to apply afresh in accordance with new regulations.

3. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
