HON'BLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No.12157 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against petitioner/accused in S.C.No.546 of 2015 of I-Additional District and Sessions Judge, Ranga Reddy District, registered for the offences punishable under Sections 376 (2)(i)(n), 313 and 506 of IPC and Sections 3 and 4 of Protection of Children from Sexual Offences Act, 2012.

Heard and perused the material available on record. It is submitted by the learned counsel appearing for petitioner that the victim in this case is not a minor as alleged and she is a major and he has produced certain educational records to substantiate his contention that the victim is a major.

Having regard to the facts and circumstances of the case, this Court cannot go into the aspect whether the victim in the case is a minor or major. As such, this criminal petition is disposed of, directing the learned I-Additional District and Sessions Judge, Ranga Reddy District, to take into consideration such of the documents that are produced by the petitioner/accused in support of his contention that the victim in the case is not a minor but major.

Subject to above direction, this Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
