HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3607 of 2018 ORDER:

In this petition filed under Section 482 Cr.P.C., the petitioners/A6 and A7 seek to quash the proceedings against them in S.C.No.12 of 2018 on the file of VI Additional Metropolitan Sessions Judge, Secunderabad registered for the offence under Section 3(1)(x) of SCs. and STs. (POA) Act, 1989 and Sections 323, 509 r /w 34 IPC.

2) It is seen the matter is coming up for framing of charges. Having regard to the stage of the case, this Court is not inclined to quash the proceedings. However, petitioners are at liberty to file an appropriate petition seeking to discharge them in the case if they are so advised, in which case the trial Court shall pass an appropriate order on merits. 3) On the submission of learned counsel for petitioners that 1st petitioner has recently got job in Tamil Nadu State and he has to attend his job and that second petitioner is 75 years old lady, their appearance before the trial Court is dispensed with except on the occasions when the trial Court requires their attendance.

4) Criminal Petition is accordingly disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
