The grievance of the petitioners is that the respondent authorities are not receiving application filed by the petitioners for grant of building permission in respect of the property bearing Municipal No.14-8-552, admeasuring 193 sq.yards situated at Jumerat Bazar, Hyderabad and also insisting for No Objection Certificate from the District Collector.

Learned counsel for the petitioner submits that in view of the judgment reported in Hyderabad Potteries Private Limited vs. Collector, Hyderabad District1, the respondents cannot insist for production of No Objection Certificate for considering the application of the petitioners made for grant of building permission.

Leaned Standing counsel for respondents Sri N.Ashok Kumar submits that if the prima facie title is satisfied, the respondent authorities would consider the application of the petitioners for grant of building permission. In view of the above submission, the respondents are directed to receive the application of the petitioners for grant of building permission, if the same is in order as per the Hyderabad Municipal Corporation Act, 1955 and Rules made thereunder and thereafter, dispose of the same in accordance with law without insisting 'No Objection Certificate'. within a period of four (04) weeks from the date of receipt of application of the petitioner.
