THE HON'BLE JUSTICE G.SRI DEVI Criminal Petition No.3113 of 2019 ORDER:
This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioners/accused Nos.1 to 8 seeking to quash the proceedings in C.C.No.301 of 2019 on the file of the Judicial First Class Magistrate, Medak, for the offence punishable under Sections 448, 504 and 509 IPC.
2. Though the present Criminal Petition is filed seeking quashing of further proceedings in the abovesaid Calendar Case, at the time of hearing, learned counsel for the petitioners restricts his prayer seeking dispensation of the presence of the petitioners before the trial Court.
3. The learned Additional Public Prosecutor submits that since the identity of the petitioners is not in dispute in the present case, their presence in the above C.C. may not be necessary on every date of adjournment.
4. Having regard to the facts and circumstances of the case and considering the rival submissions, the personal appearance of the petitioners in C.C.No.301 of 2019 on the file of Judicial First Class Magistrate, Medak, is hereby dispensed with except on the dates specifically required by the trial Court.
5. Accordingly, the Criminal Petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
