THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.22363 OF 2004 ORDER:
This writ petition is filed seeking to issue a writ of certiorari calling for the record relating to and connected with I.D.No.147 of 2001 on the file of respondent No.2 - Labour Court, Warangal, and quash the order, dated 17.11.2004 passed therein to the extent of not awarding back wages and continuity of service.
2. Heard learned counsel for the petitioner, and learned Government Pleader for Labour.
3. When the matter is taken up for hearing, it is brought to the notice of this Court that the petitioner has attained the age of superannuation during pendency of this writ petition. The learned counsel for the petitioner mainly contends that the terminal benefits of the petitioner prior to his removal from service may be paid to him.
4. Having considered the submissions made by the learned counsel for the parties and perused the record, I am of the view that the petitioner is entitled for the terminal benefits for the service rendered by him prior to his removal from service.
5. Accordingly, the present Writ Petition is disposed of, directing respondent No.1 - Corporation to pay the terminal benefits of the petitioner for the service rendered by him prior to his removal from service, if not already paid, in accordance with the Regulations,
within a period of four (4) weeks from the date of receipt of a copy of this order. However, in the circumstances of the case, there shall be no order as to costs.
As a sequel thereto, Miscellaneous Petitions, if any, pending in the present writ petition stand closed.
